Motion to Quash
Nearly all pretrial discovery includes at least one dispute where one party refuses to answer an interrogatory or produce a document. In those instances, the refusing party files a Motion to Quash with the court requesting that the interrogatory, for example, be quashed or ruled improper. If the judge agrees and grants the motion, the party does not have to respond to the objected discovery.
