Previously enacted state antisodomy laws were declared unconstitutional by the U. S. Supreme Court in 2003. The Court ruled that the Due Process clause protects an individual's liberty in deciding matters relating to marriage, procreation, contraception, family relationships, child rearing and education. Since antisodomy laws violated the right to decide those matters, they are not constitutional.
